It's unfortunate that there are so many "recording" websites out there with very poor advice. This forum realy is an oasis in a desert. Misinformation is flourishing out there and when you try to add a bit of reality, the flames start comin'.

That said, the second suggestion :"...host the file elsewhere and maybe you can talk your school to linking to it." procedure has been used in the Song & Mix Critique forum and I'm guessing is viewed as acceptable practice.

Faking a license, as was suggested as his first option, would require an idiot to administer this, thinking that no harm would come from claiming ignorance of ownership/law.

I like the fact that the mod recommended not only misappropriating the mechanical license, but committing fraud. What's next? Grand Theft? The internet is a great place to get advice. I'm going to go meet this very friendly (but lonely) Russian girl instead of reading that forum.

The only person who consistently gives bad advice here is some numpty from Scotland called Codemonkey. Ignore him if you see him, will you.

Now that I've lost your attention, I'm free to make disrespectful comments towards your family. But I won't, because you're not paying attention and I don't want to seem schizophrenic.

That has got to be a terrible bit of advice, for definite.

Interesting post.

I want to throw this out there for everybody, just a quick thought then I gotta go pick up the kids' toys and put 'em to bed.

I totally disagree with the mod / admin / whatever that dude is on that forum as far as lying about the license, however, when it comes to links to cover songs that are not for sale or hire have we considered not only those covers freely available on youtube - with video of the cats playing no less? Or how about soundclick - how do they get away with all the cover tunes posted there?

I post on soundclick & when I do I have the option to protect myself (I'm using the word protect loosely) from copyright infringement of original compositions I've recorded and / or performed on via certain options on the band page.

I haven't had time to dig into the copyright issue of cover songs, but I can tell you there are thousands available to stream and download there - how is that kosher?

I'm fairly positive that the answer is in the fact that those covers are not for sale, along with the fact that credit is given to the original artists...

This is a huge gray area to me, anyone have anything to add?

The sheer enormity of the problem makes any one rights holder be dismayed. Just because lots of people are doing this doesn't make it right. And worst is that some of the people doing it are content creators themselves. A lawyer could easily argue that this people are indeed profiting from the unauthorized use of the composition , as it is use for promotional purposes which in the end result in profit making. I think you should make time to look into this for your own benefit. This might help:

I did a mastering project a couple of years ago for a client. It was a game and we took 30 seconds from each of 100 top selling songs to use as part of the game. I kept asking the client if he had the mechanical licenses for all this music but he kept telling me that his "entertainment" lawyer was working on it and that I should not worry. I finally said that I could go no farther until he provided me with proof of the licenses as I did not want to get him or myself in trouble. He said that his lawyer was not available but that as soon as he got a hold of him everything would be OK. Time dragged on and then about 6 weeks later I get a call from my client saying that he wants to come over to talk. So he shows up and tells me that he went to his lawyers office, it was closed and all the furniture was gone and there was no forwarding address on the door. He called the building's owner and the owner told him that the lawyer had come in the middle of the night, cleaned out his office and still owed the owner for 6 month's rent. We later found out that this "lawyer" was not a lawyer at all and was subsequently busted for fraud and fleecing local musicians of hundred's of thousands of dollars for giving them "advice" that was not legal or very good. We had to destroy all of the mastering that I had done and my client was out the money for the mastering as well as the money he had paid to the "lawyer" Maybe this is the same guy still giving out BAD advice.....
