When trademarking a band name, it asks for the "class" it is under. Does anyone know what class it is? The best I could find was "entertainment" class 41.
I don't know that much about trademarking, but you can have a basic patent on your band name simply by mailing the name, date, and (if you want) the signature of a few witnesses. It forms a basic patent. Just keep the envelope sealed in case of a legal issue. A sent a few to friends as well.
